General Terms and Conditions of Business and Use for Rent A Ride

General Provisions

1.1 Subject matter
Bayerische Motoren Werke Aktiengesellschaft, Petuelring 130, 80788 Munich, a company with its registered place of business in Munich and recorded in the Commercial Register at the Local Court of Munich under registration number HRB42243 (hereinafter “BMW AG” or “BMW”), operates an online platform under the name “Rent A Ride” on the website, www.rentaride.com, as a pilot project (hereinafter “Rent A Ride”). Rent A Ride allows participating supplier, A. & CH. PAPANIKOLAOU OE (hereinafter “Rent A Ride Partners”) to offer BMW motorcycles, BMW motorcycle accessories, and motorcycle gear (hereinafter “Rental Items”) to natural persons and legal entities (hereinafter “Customers”) (hereinafter “Rental Offers”), and Customers may search, compare, and accept Rental Offers of Rent A Ride Partners. Rent A Ride is available to Customers subject to these General Terms and Conditions of Business and Use. BMW’s role in Rent A Ride is limited to brokering Rental Offers of Rent A Ride Partners, with whom Customers enter into separate contracts which are merely brokered by BMW and to which BMW is not a party. BMW assumes no responsibility for the performance of rental contracts by Rent A Ride Partners.

1.2 Website
The current version of these General Terms and Conditions of Business and Use may be viewed, downloaded, and printed out on the website, www.rentaride.com.

1.3 Pilot project
The Customer understands that the Rent A Ride service is a pilot project, in particular that Rent A Ride interfaces and the fulfillment of Rent A Ride reservations by Rent A Ride Partners are being
tested in real-life situations. Customer hereby acknowledges that data transmissions may be subject to technical malfunctions, errors, and delays. Moreover, BMW makes no warranty for the entire process chain of the renting transaction. Participating Parties

2.0 BMW as broker
BMW AG brokers rental contracts for Rental Items on Rent A Ride. When a reservation is made, a rental contract will be formed directly between the Customer and the Rent A Ride Partner offering the selected Rental Item on the Rent A Ride website. The role of BMW is limited to that of a broker. This means that BMW is not a party to rental contracts between Customers and Rent A Ride Partners and that BMW has no control over rental terms, conditions, or rates of Rent A Ride Partners.

2.1 Rent A Ride Partner as Customer’s contracting partner
BMW offers Customers the opportunity to browse Rental Offers on the Rent A Ride online platform and to rent Rental Items from Rent A Ride Partners. Customers search the Rent A Ride online
platform for desired products. Search results displayed on the Rent A Ride online platform may differ from search criteria, in particular if there are no available Rental Offers that fully meet the search BMW Motorrad Papanicolaou RENT A RIDE criteria of a Customer. Rental Offers on Rent A Ride are limited to Rental Items that are available for rent from Rent A Ride Partners.

2.2 Rental contracts
Rental contracts for Rental Items selected by Customers are subject to the rental terms and conditions of Rent A Ride Partners. Rental Offers on the Rent A Ride online platform are based on
information that has been uploaded by Rent A Ride Partners to a dedicated Rent A Ride system and that has been approved by Rent A Ride Partners for publication. Information displayed on Rent A Ride, including, without limitation, availability, prices, and other rental terms and conditions, are solely the responsibility of Rent A Ride Partners. Exceptions apply to general information about the Rent A Ride program as a whole, selection criteria of search screens, screens for entering personal data, and vehicle descriptions for various models.

3.0 Reservation process
To rent a Rental Item, a Customer must first select the desired Rental Item on the Rent A Ride online platform. The Customer then provides his/her personal data (name, address, email address and data, information related to payment) and selects the rental term and any add-on options. The Customer is thereupon provided with an opportunity to review all information and to make any necessary corrections. By clicking the button “Book now with obligation to pay”, the Customer makes a legally binding representation to the Rent A Ride Partner to rent the selected Rental Item subject to the terms and conditions of the Rent A Ride Partner.

3.1 Reservation confirmation

3.1.1 Reservation confirmation for Rental Offers without an obligation to pay a deposit
If the rental terms and conditions of a Rent A Ride Partner do not require a deposit for reservations, the reservation will be confirmed as follows: By clicking the button “Book now with obligation to pay”, the Customer instructs and authorizes BMW to broker the specified rental contract with the Rent A Ride Partner. The Customer has to confirm his booking with his email address by way of an email link by clicking on “Confirm booking now” within 24 hours (hereinafter “Email Confirmation by the Customer”). If the Email Confirmation by the Customer is not carried out within 24 hours, the Rent A Ride internet platform will delete the booking. If the Email Confirmation is successful, Rent A Ride will immediately confirm the receipt of the booking in the name of the Rent A Ride Partner to the email address provided by the Customer within the course of the booking process (hereinafter “Reservation Confirmation”). This Reservation Confirmation will also result in a rental contract between the Customer and the Rent A Ride Partner.

3.1.2 Reservation confirmation for Rental Offers with an obligation to pay a deposit
If the rental terms and conditions of a Rent A Ride Partner do require a deposit for reservations, the reservation will be confirmed as follows: By clicking the button “Book now with obligation to pay”, the Customer instructs and authorizes BMW to broker the specified rental contract with the Rent A Ride Partner. In the name of the Rent A Ride Partner, Rent A Ride will promptly confirm receipt of the reservation to the email address provided by the Customer during the reservation process (hereinafter “Reservation Confirmation”). This Reservation Confirmation will also result in a rental contract between the Customer and the Rent A Ride Partner. Furthermore, the Customer will be forwarded promptly to the payment process on the Rent A Ride internet platform. If the Customer BMW Motorrad Papanicolaou RENT A RIDE does not pay the deposit within 24 hours after clicking on the button “Book now with obligation to pay”, Rent A Ride will automatically cancel the booking and terminate the rental contract between the Customer and the Rent A Ride Partner.

3.2 Transmission as authorized messenger
During the reservation process, BMW acts as an agent of the Customer in forwarding the Customer’s reservation request to the appropriate Rent A Ride Partner. BMW will be able to ensure proper processing of a reservation only if the Customer has correctly and fully provided all necessary data, including, without limitation, the Customer’s contact information, the rental term, the vehicle model, and any additional Rental Items.

3.3 Data storage
Reservation data will be stored by BMW or an authorized service provider. Reservation data and general terms and conditions will be shown again in the Reservation Confirmation and can be
downloaded as a file.

Payment and Deposit

4.0 No fees to BMW
BMW does not charge Customers any fees for its brokerage services.

4.1 Payment of rental prices to Rent A Ride Partners
Payment of the rental price to the Rent A Ride Partner is subject to the rental terms and conditions of the Rent A Ride Partner who is the contract partner of the Customer.

4.2 Deposit and payment method
Under the rental terms and conditions of a Rent A Ride Partner, Customers may be required to pay a deposit for a rental contract to that Rent A Ride Partner. The exact terms and conditions for such a deposit are set forth in the rental terms and conditions of the Rent A Ride Partner, which can be viewed before a final reservation is made. If the Customer does not pay the deposit within 24 hours after clicking on the button “Book now with obligation to pay”, Rent A Ride will automatically cancel the booking and terminate the rental contract between the Customer and the Rent A Ride Partner. After a successful payment of the deposit, a confirmation message will appear on the internet platform to inform the Customer, that the deposit has been paid. The Customer will also receive an information about his successful payment in an email. Customers must pay the deposit using the payment method made available on the Rent A Ride online platform, i.e., the payment method to which Customers are linked during the reservation process. Rental contracts are concluded as provided in Section 3.2. If a Customer chooses to pay the deposit by credit card, then the Customer must expressly authorize the Rent A Ride Partner to charge the Customer’s credit card account the amount that is due. For such reservations, the Customer agrees that the deposit amount shown during the reservation dialog or the total amount due for the reservation, including any taxes and fees, will be charged directly to his/her/its credit card. Rent A Ride has no access to funds paid by Customers. If a Customer chooses to pay the deposit using PayPal, the Customer will make payment directly on the page linked to the Rent A Ride online platform.BMW Motorrad Papanicolaou RENT A RIDE Cancellation or Modification of Rental Contracts

5.0 Cancellation of rental contracts
Customers may cancel rental contracts within the cancellation period specified in the applicable rental terms and conditions by using the cancellation link in the Reservation Confirmation from Rent A Ride. Under the rental terms and conditions of a Rent A Ride Partner, Customers may be required to pay a reasonable cancellation fee after the contract date. Detailed cancellation terms and conditions can be found in the rental terms and conditions of the Rent A Ride Partner, which will be shown to the Customer during the reservation process. Any other rights of Customers remain unaffected.

5.1 Modification of rental contracts
Whether a rental contract can be modified depends on the rental terms and conditions of each Rent A Ride Partner. If a Customer would like to modify a rental contract, the Customer must contact the Rent A Ride Partner directly by email or telephone to the contact details indicated in the rental terms and conditions of the Rent A Ride Partner.

Information about Rental Offers

6.0 Rental Offers
Information about Rental Offers (including prices) of Rent A Ride Partners displayed on the Rent A Ride online platform reflects the information provided by those Rent A Ride Partners. BMW has no control over and therefore assumes no responsibility for the accuracy of such information. Exceptions apply to general information about the Rent A Ride program as a whole, selection criteria of search screens, screens for entering personal data, and vehicle descriptions for various models.

6.1 Ranking of Rental Offers on Rent A Ride
The results of the Customer’s search for Rental Offers will be displayed on the Rent A Ride online platform as follows:
1. Alphabetical order according to country
2. Within a country, alphabetical order of the Rent A Ride Partners
3. Within the Rental Offers of a Rent A Ride Partner, alphabetical order of the vehicle models
If there are no Rental Offers available which match the Customer’s search criteria, Rent A Ride will suggest Rental Offers to the Customer which are similar to the search criteria.

Data Protection
BMW collects, stores and uses the personal data provided by the Customer in accordance with the statutory provisions, as far as this is necessary for the establishment, content arrangement or
amendment of the contractual relationship (inventory data) and the utilization and settlement (usage data) of the bookings and contracts brokered under it. BMW is entitled to pass on all necessary data, including personal data provided by the Customer such as name and contact data to the Rent A Ride Partner, as far as this is necessary for the establishment, execution, amendment or BMW Motorrad Papanicolaou RENT A RIDE termination of the respective contractual relationship between the Customer and the respective Rent A Ride Partner. The Customer must inform BMW immediately of any changes to the personal data regarding the contractual relationship. For that matter BMW processes the customer’s personal data in accordance with the applicable data protection law. Data Security
The servers of BMW AG are protected by state-of-the-art technology, including, without limitation, firewalls; the Rent A Ride Customer is aware, however, that there is a risk for all contracting parties that transmitted data will be intercepted during the transmission process. This applies not only to an exchange of information by email where information leaves the system, but also to integrated applications, such as weblogs, user messages, etc., and to any other data transfers. As a result, the confidentiality of data transmitted while using the Rent A Ride online platform cannot be guaranteed.

Liability

9.0 No liability for Rent A Ride Partners
BMW assumes no responsibility for the performance of rental contracts or any other acts by Rent A Ride Partners. Rent A Ride Partners are not agents of BMW.

9.1 General principle
Any liability of BMW for damages suffered by Customers, whatever the legal basis (contract, tort, breach of a contract or other obligation [Schuldverhältnis], indemnity, etc.), is hereby disclaimed and excluded, subject to Section 9.3 and to the greatest possible extent under applicable law for Customers which act as consumers.

9.2 No limitation of liability
The limitation of liability in Section 9.2 shall not apply to (i) intentional or grossly negligent acts or omissions, (ii) harm to life, limb, or health, (iii) fraudulently concealed defects, (iv) liability under a guarantee (in which case, any liability provisions applicable to the guarantee are dispositive), (v) any claims under product liability provisions, (as far as they are applicable) or (vi) any damages resulting from a breach of material contractual obligations (cardinal obligations [Kardinalpflichten]), such as obligations which, given the terms and purpose of the contract as a whole, are precisely intended to be incumbent upon BMW, or the performance of which is a prerequisite for due performance of the agreement, and on compliance with which Customers may reasonably rely and generally do rely. Nevertheless, any liability for damages caused by a breach of contract due to ordinary negligence shall be limited to reasonably foreseeable damages.

9.3 Liability for loss of data
In the event of a loss of data, BMW will incur liability (i) subject to the foregoing limitations of liability and (ii) only if the loss of data could not have been avoided through reasonable data backup

9.4 Liability for officers, directors and agents
The foregoing limitations of liability shall also apply to any claims for damages brought by a Customer against a statutory representative, agent, or employee of BMW.

Choice of law
The laws of the Federal Republic of Germany govern, provided however that if the Customer is a consumer and mandatory provisions of the law applicable at the place of the Customer’s habitual
abode are more favorable to the Customer than German law, then such provisions shall take precedence over German law.

Contract Language
The official contract language shall be the language that is selected by the Customer when making the reservation.

Judicial Forum and Consumer Dispute Resolution

13.0 Judicial forum
If the Customer is a legal entity within the meaning of German law, then exclusive venue and jurisdiction for any and all present or future claims arising from the business relationship shall lie
with the competent courts of Munich, Germany.

13.1 Consumer dispute resolution
In accordance with Directive 2013/11/EU (Directive on consumer alternative dispute resolution), the EU Commission has created an online platform for the online resolution of disputes among
businesses and consumers. This platform is available at http://ec.europa.eu/consumers/odr. BMW’s email address for the purposes of this paragraph is service@rentaride.com. The venue and
jurisdiction provisions of Section 13.1 above shall also apply if the Customer’s place of residence or habitual abode is unknown at the time legal action is filed or if the Customer voluntarily decides to bring proceedings against BMW before the courts indicated under Section 13.1. In all other cases, BMW Motorrad Papanicolaou RENT A RIDE actions against Customers acting as consumers shall be brought before the courts of the place of residence or habitual abode of such Customers. For Consumers outside of Finland: BMW will not participate in dispute resolution proceedings before any consumer mediation boards within the meaning of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG) and the meaning of the above-mentioned European
Directive on consumer ADR. BMW is also not obliged to participate. For Consumers in Finland only: If a dispute between BMW and a consumer Customer cannot be resolved by amicable negotiations between BMW and the consumer Customer, the consumer Customer may bring the matter under dispute to the national Consumer Dispute Board (https://www.kuluttajariita.fi/fi/) to be resolved. Before taking the matter under dispute to the national Consumer Dispute Board, the consumer Customer must be in contact with the consumer advisory services (https://www.kkv.fi/kuluttajaneuvonta/).

Rent A Ride Privacy Policy

We aim to create and maintain the basis for a trust-based business relationship with our customers and interested parties. We take the confidentiality and integrity of your personal data extremely seriously. Therefore, we will store your data with care, for a specific purpose (and/or in accordance with consent you have provided to us) and will process and use it in accordance with legal provisions regarding data protection.

The following Rent A Ride Privacy Policy describes how BMW AG collects, processes and uses personal data belonging to its customers and interested parties on the Rent A Ride Internet platform. You can also find further information on how BMW AG or our BMW distributors process your data as a whole in the privacy policy provided by the BMW sales company concerned.

Who is the Data Controller for data processing purposes?
BMW AG (hereinafter ‘BMW’ or ‘we’, ‘us’), Petuelring 130, 80788 Munich, Germany is the Controller for the processing of your personal data within the meaning of the European Union General Data Protection Regulation (‘GDPR.’)
BMW AG is the parent company of the BMW Group and operates the website www.rentaride.com. Using www.rentaride.com, we coordinate the business activities of the online brokerage platform ‘Rent A Ride’ via participating supplier, A. & CH. PAPANIKOLAOU OE (‘Rent A Ride Partner’). BMW motorcycles and BMW Motorrad parts, accessories and riding equipment can be offered for rental via the site, and customers may browse, compare and book the rental offerings made by Rent A Ride Partners.
BMW acts via Rent A Ride as a broker for the rental offerings of Rent A Ride partners. The customer concludes separate contracts with these Rent A Ride Partners which are merely brokered by BMW. In the event of a booking the rental contract is concluded exclusively between the customer and the Rent A Ride partner concerned. BMW acts solely as a broker in this process.
BMW AG is the Controller for your data as processed via the website www.rentaride.com. BMW also processes your data to the extent it is transferred to BMW from Rent A Ride partners, provided and to the extent that all data protection requirements in relation to this data are met.
Rent A Ride Partners are responsible for the processing of such personal data as you yourself provide to them in connection with your enquiry and which you make available to customer support. Rent A Ride partners also process your data independently as Controllers to the extent this data is transferred by us, provided and to the extent that all applicable data protection requirements are met.
The present privacy policy also describes certain ways in which your data is processed by Rent A Ride partners. However, it is possible Rent A Ride partners may collect additional personal data, and may have their own privacy policies in place. In this case, the privacy policy provided by the Rent A Ride partner concerned will state how that partner uses your data.

When does Rent A Ride collect and process personal data?
We collect and process your personal data in a variety of circumstances including:

 If you contact us directly, e.g. via our website.
 If you complete a booking process for e.g. a rented motorcycle on our website.
 If you respond to our direct marketing activities (e.g. if you fill in a reply card).
 If your personal data is transferred to us by Rent A Ride Partners, our BMW national distributors or third parties, provided and to the extent that the data protection requirements for such processing are met (e.g. you have given your consent).
 If other BMW Group companies and our commercial partners provide data to us by permitted means, and
 if third parties (e.g. certified address providers) provide us with your personal data by permitted means.
Please help us to keep your details up to date by informing us of any changes to your personal data, and in particular to your contact details.

What data can be collected about you?
We can collect the following categories of personal data using the services and communication channels described in the present privacy policy:
 Contact details ► Name, address, phone number, email address.
 Other personal data ► Information provided by you regarding your date of birth, driving licence number, how long you have held your licence, national ID card/passport number and the country which issued it.
 Contractual details ► Booking numbers, invoice numbers.

 Transaction and interaction data► Information regarding rental of BMW motorcycles, vehicle equipment, rider equipment or insurance premiums, interactions with Rent A Ride customer support (your enquiries and complaints) and Rent A Ride Partners, and participation in market research.
 Credit record and identity information ► Data establishing your identity, e.g. national ID card or driving licences; transaction information, including any outstanding payments to our partners; information on cases of fraud; deliberate destruction of leased objects, criminal acts, suspicious transactions, politically exposed persons and sanctions lists in which your data may be included.
What is your personal data used for?
Data collected in connection with Rent A Ride is used for the following purposes. You can find more information about how BMW AG or our BMW distributors generally process our customers’ personal data here or on the website of the BMW sales companies concerned.

A. Conclusion and performance of a contract (Art. 6 (1) (b) GDPR)
BMW acts via Rent A Ride as a broker for the rental offerings of Rent A Ride partners. The customer concludes separate contracts with these Rent A Ride Partners which are merely brokered by BMW. In the event of a booking the rental contract is concluded exclusively between the customer and the Rent A Ride partner concerned. BMW acts solely as a broker in this process.
In connection with the booking process and the conclusion of the contract between the customer and the Rent A Ride partner concerned, we will process the following personal data.
As part of this activity the following categories of data are processed:
 Contact details (Full name, address, email address, etc.)
 Other personal data (date of birth, driving licence number, how long you have held your licence, national ID/passport number and the country which issued it).
On the completion of the booking process on Rent A Ride we will transfer your personal data to the Rent A Ride partner concerned. The Rent A Ride partner shall use your personal data in order to contact you regarding the performance of the contract (e.g. booking process, vehicle ordering, booking of BMW Connected Ride services) or to deal with an enquiry formulated by you (e.g. enquiries about the range, test ride requests). We or Rent A Ride will contact you regarding any aspect of the performance of a contract or handling an enquiry without further consent from you. This may be in writing, by phone, using a messenger service or by email depending on the contact details you provided.

B. Customer support
(Art. 6 (1) (b, c, f) GDPR)
BMW and Rent A Ride partners shall use your personal data to contact you regarding the performance of the contract as above (e.g. booking process, vehicle ordering, booking of BMW Connected Ride services) or to handle an enquiry formulated by you (e.g. enquiries about the range, test ride requests, enquiries and complaints to BMW Motorrad customer services). We will contact you regarding any aspect of the performance of a contract or handling an enquiry without further consent from you. This may be in writing, by phone, using a messenger service or by email depending on the contact details you provided.
In carefully selected cases we will also contact you with marketing communications (e.g. sending relevant offers) where and to the extent that the necessary data protection requirements are met and you have not objected to the use of your data for the purposes of contact in writing despite being aware of your right to do so.
BMW will also process your personal data on this basis in order further to optimise your BMW Motorrad customer support experience and, for example, in order clearly to identify you when you contact us.

C. Marketing communications and market research on the basis of consent (Art. 6 (1) (a) GDPR )
Provided you have given your consent to wider-ranging use of your personal data, your personal data may be used to the extent described in your consent, including for marketing purposes (selected offers on products and services) and/or market research, and may be forwarded to some subsidiaries of BMW AG and selected BMW Motorrad partners as appropriate. Further details can be found in the declaration of consent concerned. You may withdraw this consent at any time.
If you have given the appropriate consent to marketing communications, BMW shall collect and process the following details:
Contact details, e.g. Name, address, email address, telephone number
Additional personal details / preferences, e.g.
 Driving licence information.
 Your status in terms of your declaration of consent in terms of data protection, and selected/preferred communication channel
Identification details, e.g.
Customer number, contract number
Customer history, e.g.
 Booking history including model, booking period
 Advertising campaign history and impact (customer and interested parties support programmes and direct marketing initiatives)
 Participation in events

Data processing for marketing purposes generally takes place in Germany. Under no circumstances will personal data be transferred to any country outside the EU.

D. Compliance with legal obligations to which BMW is subject
(Art. 6 (1) (c, f) GDPR)
Collected data is also processed as part of assuring the operation of IT systems. ‘Assurance’ includes the following activities among others:
 Securing and recovering data processed in IT systems,
 Logging and monitoring of transactions to ensure the correct functioning of IT systems,
 Detecting and preventing unauthorised access to personal data.
 Incident and problem management with a view to rectifying any disruption to IT systems.
BMW is subject to a variety of further legal obligations. In order to fulfil these obligations, we process your data to the extent required and provide it to the responsible authorities where required as part of our legal reporting obligations.
We will also process your data in the event of any legal dispute, should the nature of the dispute require such processing of your data.
H. Transfer of data within the BMW Group
BMW AG is part of the BMW Group From time to time, and following careful checks, we will transfer your data to other BMW Group companies, which will then process this data themselves as the Controller. Such data transfers may occur under the following circumstances and for the following purposes:
Please note that this does not constitute an exhaustive or definitive list of data transfer processes within the BMW Group, and serves merely to provide examples designed to make data transfer processes more transparent.
 If you have given us your prior express permission to share your data with the BMW Group for advertising or marketing purposes, and specifically to share it with the BMW distributor and certain authorised dealers in your home market or the market in which you are currently resident.
E. Transfer of data to selected third parties
Provided and to the extent that the necessary data protection requirements are met, data will be sent to companies such as:
 Rent A Ride partners (e. g. in order to perform your contract with the Rent A Ride partner concerned or to handle your request for a test ride or servicing, and in order to present specific offers to you).
Rent A Ride partners for the purpose of updating their data (for example your contact details). Data used to update your details will be sent to all Rent A Ride partners which hold your address details in their databases.
 Carefully selected and tested service providers and commercial partners with whom we cooperate, in order to offer you products and services. How do we keep your personal data safe?
We use a variety of security measures including state-of-the-art encryption and authentication tools in order to ensure and maintain the safety, integrity and availability of your data.
It is impossible to guarantee that any transfer of data over the Internet or via a website is completely protected against unauthorised access. However, together with our service providers and commercial partners, we do everything in our power to protect your personal data in accordance with applicable data protection legislation by physical, electronic and procedural means, in line with the current state of technology. The measures we implement include:
 Strict criteria for authorisation to access your data, allowing access on a ‘need to know’ basis (limiting authorisation to the minimum possible number of individuals) and for the given purpose only.
 Transfer of collected data in encrypted form only.
 Storage of confidential data (e.g. credit card data) in encrypted form only.
 Firewalled IT systems to protect against unauthorised access (e.g. by hackers) and
 constant monitoring of access to IT systems to detect and prevent any abuse of personal data.
If you have received a password from us or have issued one yourself which allows you access to certain areas of our website or to other portals, apps or services operated by us, you are responsible for ensuring this password remains confidential and for compliance with any and all other security procedures of which we may make you aware. Specifically we ask you not to share your password with anyone.

How long do we keep your data?

We will retain your data only for as long as is necessary for the purpose in connection with which we process your data. If we process your data for several purposes, it will be automatically deleted, or saved in a format which does not allow it to be directly attributed to you, as soon as the last specific purpose has been achieved. In order to ensure that all your data is deleted in accordance with the principle of minimisation of data, BMW has drawn up an internal deletion plan. The fundamental principles according to which your personal data shall be deleted under this plan are set out below.
Use in order to perform a contract
We may store data collected from you for as long as the contract remains in force and, depending on the nature and scope of the contract, for 6 or 10 years thereafter, in order to comply with statutory storage requirements and to clarify any queries or claims which may arise following the expiry of the contract.
Moreover, for some contracts regarding the delivery of products and services, a longer storage period is required. For further information see ‘Use for the examination of claims’ below.
Use for the examination of claims Data we deem necessary in order to examine or defend claims against us, or in order to initiate a prosecution against you, us or a third party, or in order to assert a claim, may be retained by us for as long as there is a likelihood of such proceedings being initiated.
Use for customer support and for marketing purposes
Data collected from you for purposes of customer support and marketing will be stored until such time as the relevant consent to do so is revoked. You may withdraw your declaration of consent to any future use of your data at any time. You are also entitled to demand this data be deleted, provided that no contractual or statutory retention periods prevent such deletion.
Who has access to your data abroad, and how it is protected?

BMW is a global company. Personal data is accessed by BMW employees, national distributors, Rent A Ride partners, and service providers operating on our behalf, where possible within the EU.
Where data is processed in countries outside the EU, BMW AG uses EU standard contracts, including appropriate technical and organisational measures, to ensure that your personal data is processed in accordance with European data protection standards.
The EU has already determined that some countries outside the EU, such as Canada and Switzerland, offer a comparable level of data protection. Given this comparable level of data protection, data transfers to these countries do not require specific approval or agreements.

As a data subject affected by the processing of your personal data, you are entitled to exercise certain rights against us under the GDPR and other relevant data protection legislation. The following section contains details of your rights as a data subject under the GDPR. Depending on the type and scope of your query, we may ask you to submit it to us in writing.
Rights of data subjects
According to the GDPR, as a data subject you have the following specific rights in relation to BMW:
Right to information (Art. 15 GDPR): You are entitled to demand information from us about the data we hold about you at any time. This information includes, for example, the categories of data processed by us, the purposes for which we are processing it, the origin of the data (where we have not obtained it directly from you) and, if appropriate, the recipients to whom we have sent your data. You can obtain a copy of your data from us free of charge. If you are interested in obtaining any further copies, we reserve the right to charge you for these additional copies.
Right to rectification (Art. 16 GDPR): You are entitled to demand we rectify your data. We will take proportionate measures to ensure the data we hold about you and are continuing to process is accurate, complete and up-to-date, based on the most recent information available to us.
Right to erasure (Art. 17 GDPR): You are entitled to demand we erase your data provided that the legal conditions for such erasure apply. According to Art. 17 GDPR, this may be the case where
 the data is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
 you withdraw the consent on which the processing is based and where there are no other legal grounds for the processing;
 you object to the processing of your data and there are no overriding legitimate grounds for the processing, or you object to the processing of the data for direct marketing purposes;
 The data has been unlawfully processed;
Right to restriction of processing (Art. 18 GDPR) You may demand we restrict the processing of your data where
 you contest the accuracy of the data over the period of time we require in order to verify the accuracy of the personal data;
 the processing is unlawful and you oppose the erasure of your data and request the restriction of its use instead;
 we no longer need the data for the purposes of the processing, but you require it for the establishment, exercise or defence of legal claims;
 you have objected to processing where it has still to be determined whether our legitimate grounds override yours.
Right to data portability (Art. 20 GDPR): At your request, we will transfer your data to another Controller – to the extent this is technically possible. However, you are entitled to exercise this right only where the data processing is based on your consent or is required in order to perform the contract. Instead of receiving a copy of your data, you may also request us to transfer your data directly to another Controller specified by you.
Right to object (Art. 21 GDPR): You may object to the processing of your data at any time on grounds relating to your particular situation, provided the data processing is based on your consent or on our legitimate interests, or those of a third party. In this case we will stop processing the data. The latter shall not apply where we can demonstrate compelling legitimate grounds for the processing which override your interests, or where we require your data in order to establish, exercise or defend legal claims.
Timescales for granting rights of data subjects
We make every effort to handle all enquiries within 30 days. However, this timescale may be prolonged depending on the specific data subject right concerned or on the complexity of your enquiry.
Restriction of the right to information when granting rights of data subjects
In certain situations we may be unable to provide you with information about any or all of your data due to legal constraints. In the event we are forced to refuse a request for information in such a case, we will inform you of the reasons for the refusal at the same time as the refusal is issued.
Complaints to supervisory authorities
